These Terms of Service (“Terms”) govern your access to and use of the OBD Soft website (obd-soft.com), accounts, download pages, files, guides, support services, remote installation services, and related content (collectively, the “Services”).

By accessing or using the Services, creating an account, placing an order, or downloading any file, you agree to these Terms. If you do not agree, you must not use the Services.

1. About the Services

OBD Soft provides access to server infrastructure, bandwidth, file-delivery systems, installation materials, support, and related maintenance services.

OBD Soft does not sell or transfer ownership of third-party software. Software made available through the Services may be publicly available, distributed by third parties, or owned by its original author or rights holder. Unless a product page expressly states otherwise, amounts charged for digital access cover the use of bandwidth, server infrastructure, protected delivery systems, support, maintenance, and any OBD Soft-created materials included with the download. Payment does not transfer ownership of third-party software or any underlying intellectual property rights.

2. Eligibility and Lawful Use

You must be at least 18 years old, or the age of legal majority where you live, to create an account or place an order.

You agree to provide accurate, current, complete, and verifiable information. You may use the Services and downloaded materials only where lawful, and you are responsible for confirming that your access, possession, installation, and use comply with all laws and third-party license terms that apply to you.

3. Use at Your Own Risk

Files, guides, download pages, and support are provided “as is” and “as available” to the maximum extent permitted by law. You accept responsibility for deciding whether a file is suitable for your computer, diagnostic interface, vehicle, operating system, drivers, security settings, and intended use.

Before installing or using any file, you should back up important data and use appropriate security precautions. OBD Soft does not guarantee compatibility, uninterrupted availability, successful installation, particular diagnostic functions, vehicle coverage, coding results, or error-free operation.

To the maximum extent permitted by law, OBD Soft is not responsible for damage or loss caused by incompatible hardware, third-party software, customer actions, failure to follow instructions, or improper or unlawful use, including data loss, software conflicts, failed coding, vehicle faults, or hardware failure.

4. Account and Access Rules

You must not:

• register with a temporary, disposable, masked, anonymous, false, or fictitious email address;
• provide false identity, billing, location, or order information;
• access the Services through a VPN, proxy, VPS, hosting provider, cloud-based network, or other system intended to conceal or misrepresent your identity or location;
• share, sell, transfer, or permit another person to use your account, password, protected page, or download link;
• create multiple or alternate accounts to evade a restriction, suspension, or ban.

You are responsible for keeping your account, email account, passwords, and access links secure. We may require identity, payment, or order verification and may refuse or delay access when information cannot be verified or when fraud, abuse, or a security risk is suspected.

5. Download and Redistribution Restrictions

You may download and use files solely for your own lawful, personal, non-commercial use, unless OBD Soft gives you written permission for another use.

OBD Soft does not claim ownership of third-party software merely because it is accessible through the Services. Third-party software remains subject to the licenses, restrictions, and rights of its original authors or rights holders.

Downloads may also contain original materials owned by or licensed to OBD Soft, including scripts, installers, patchers, documentation, guides, utilities, packaging tools, page content, and branding (“OBD Soft Materials”). You must not copy, publish, upload, share, redistribute, repackage, modify for redistribution, rent, sublicense, resell, or commercially exploit OBD Soft Materials. You must not include them in an installation service, download collection, marketplace listing, or computer or other system prepared for sale.

Nothing in these Terms grants you rights that OBD Soft does not own or have authority to grant. You are responsible for complying with all applicable third-party licenses and intellectual property laws.

6. Prohibited Conduct

You must not:

• hack, attack, probe, exploit, overload, disrupt, or attempt unauthorized access to the website, accounts, servers, downloads, or related infrastructure;
• scrape, clone, mirror, reverse engineer, extract, or systematically copy the website, protected pages, databases, or OBD Soft Materials;
• bypass access controls, download limits, security measures, software licensing, vehicle security, or anti-theft systems unlawfully;
• upload or distribute malware, harmful scripts, stolen data, or illegal or infringing content;
• interfere with other users or abuse bandwidth, support, payment, or network resources;
• use the Services for mileage manipulation, unlawful emissions tampering, theft, unauthorized vehicle access, fraud, or any other illegal activity;
• threaten, harass, or use abusive language toward OBD Soft personnel, customers, or third parties;
• make fraudulent refund requests, false payment claims, abusive chargebacks, or misleading complaints.

7. Orders, Payments, and Refunds

You confirm that every payment is authorized and made using a valid payment method. Prices, taxes, payment methods, and availability may change without notice. We may refuse, cancel, delay, or review an order where we reasonably suspect fraud, unauthorized payment use, inaccurate information, sanctions concerns, abuse, technical error, or legal risk.

Payments for digital access are final and non-refundable after access or performance begins, including where a download link, protected page, account credential, guide, support service, or remote assistance has been provided, except where a refund is required by applicable law or expressly approved under our Shipping and Returns Policy.

Duplicate payments made because of a verified processing error will be reviewed and, where appropriate or legally required, refunded. Failure to download caused by user error, incompatible equipment, an unsupported configuration, a poor connection, failure to read compatibility information, or refusal to follow reasonable instructions does not by itself create a right to a refund.

If applicable law provides a cooling-off, withdrawal, conformity, repair, replacement, price-reduction, refund, or other mandatory consumer right, that right is not excluded by these Terms. Where permitted by law, a consumer who expressly requests immediate supply of digital content or a digital service and acknowledges the resulting loss of a withdrawal right may lose that right once supply or performance begins.

8. Support and Remote Assistance

OBD Soft may provide installation support by email, website messages, or remote assistance. If remote access is used, you are responsible for backing up your data, closing private files and accounts, supervising the session, and ensuring you are authorized to install and use the relevant software.

Support does not include unrelated computer repair, hardware repair, vehicle repair, diagnostic training, guaranteed coding outcomes, or support for unsupported third-party products unless agreed in writing.

9. Intellectual Property and Complaints

The OBD Soft website, branding, original text, guides, layouts, images, scripts, installers, utilities, and other original content are owned by OBD Soft or licensed to us. Third-party names, trademarks, logos, software, and vehicle references belong to their respective owners and are used only for identification, compatibility, descriptive, or informational purposes. OBD Soft is not affiliated with or endorsed by any third-party manufacturer or publisher unless expressly stated.

If you believe content available through the Services infringes your rights, email contact@obd-soft.com with your contact details, identification of the protected work, the exact URL, an explanation of your rights and the alleged infringement, and evidence that you are the rights holder or authorized representative. We may investigate, request further information, or remove or disable content in response to a credible complaint.

10. Suspension and Termination

We may limit, suspend, or permanently terminate an account, download access, support, or other Services if we reasonably believe you have violated these Terms, created a security or payment risk, infringed third-party rights, abused the Services or our personnel, or engaged in unlawful activity.

If your account is suspended or terminated, you must not create or use another account to evade the restriction. Related accounts may also be blocked. Termination does not entitle you to a refund except where required by law.

11. Limitation of Liability

To the maximum extent permitted by law, OBD Soft will not be liable for indirect, incidental, special, consequential, punitive, or business losses, including lost profit, revenue, data, files, goodwill, vehicle use, business interruption, repair costs, replacement costs, or third-party claims.

To the maximum extent permitted by law, OBD Soft’s total liability for a claim related to the Services is limited to the amount you paid OBD Soft for the specific access or service giving rise to the claim.

Nothing in these Terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited, including liability for fraud, fraudulent misrepresentation, or death or personal injury where caused by negligence and such liability cannot legally be excluded.

12. Indemnity

To the maximum extent permitted by law, you agree to indemnify and hold OBD Soft harmless from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful use of the Services, your breach of these Terms, your infringement of third-party rights, or your unauthorized copying, sharing, resale, or redistribution. This section does not limit non-waivable consumer rights.

13. Hardware and Physical Products

This section applies only when a product page expressly offers a physical item, such as diagnostic hardware or a computer accessory.

Physical-product sales are final except where return, refund, repair, replacement, cancellation, conformity, warranty, or withdrawal rights are required by applicable law. Any voluntary return requires prior written approval, must be sent in its original, unused, complete, and unaltered condition, and may be subject to a 25% restocking fee where permitted by law and disclosed before purchase. Unauthorized, damaged, incomplete, used, or modified returns may be rejected and returned at the sender’s expense where permitted by law.

Unless expressly provided on the product page, OBD Soft gives no voluntary or additional warranty. This does not exclude any mandatory legal guarantee or warranty that applies to the sale.

14. Jurisdiction and Disputes

The Services are offered only where OBD Soft may lawfully provide them. You must not use the Services from a location where doing so would violate applicable law or subject OBD Soft to a legal obligation that OBD Soft has not accepted.

These Terms are governed by the laws of the country where OBD Soft is legally established, without excluding any mandatory consumer protection rights or jurisdiction rules that apply in your country of residence. Before starting a formal dispute, please contact contact@obd-soft.com and give us a reasonable opportunity to resolve the issue.

15. Changes and Severability

We may update these Terms from time to time. The updated version applies from the stated effective date and will not retroactively remove rights that have already accrued where prohibited by law.

If any provision is found invalid or unenforceable, the remaining provisions continue in effect. The affected provision will apply only to the maximum extent permitted by law.
